In this privacy notice, we describe our privacy policy. We seek to explain to you in the clearest way possible what information we collect, how we use it, and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our Sites or Apps and our services.

This privacy policy applies to all information collected through our website (such as legacychurchnm.com or legacychurch.com), mobile application ("Apps"), and any related services, sales, marketing, or events (we refer to them collectively in this privacy policy as the "Sites").

What Information Do We Collect?

Personal Information You Disclose to Us

In Short We collect personal information that you provide to us such as name, address, contact information, passwords and security data, payment information, and social media login data.

We collect personal information that you voluntarily provide to us when registering at the Sites or Apps, expressing an interest in obtaining information about us or our products and services, when participating in activities on the Sites or Apps, or otherwise contacting us.

The personal information that we collect depends on the context of your interactions with us and the Sites or Apps, the choices you make, and the products and features you use. The personal information we collect can include the following:

  • Name and Contact Data. We collect your first and last name, email address, postal address, phone number, and other similar contact data.
  • Donation and Payment Data. Online donations and most other payments made through our Sites or Apps are processed by our payment provider, Pushpay. When you give or pay online, your full payment card or bank account information is submitted directly to and stored by Pushpay, not by Legacy Church. We receive only the transaction details we need to record your gift or payment, issue a receipt, and prepare year-end tax statements.   • Religious Participation Information. Because we are a church, the fact that you attend, serve, register for a class, give, or otherwise engage with Legacy Church relates to your religious beliefs and is considered sensitive in many privacy laws. We treat this information with care and do not share it with third parties for marketing or commercial purposes.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information Automatically Collected

In Short Some information, such as IP address and browser or device characteristics, is collected automatically when you visit our Sites or Apps.

We automatically collect certain information when you visit, use, or navigate the Sites or Apps. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Sites or Apps, and other technical information. This information is primarily needed to maintain the security and operation of our Sites or Apps, and for our internal analytics and reporting purposes.

Information Collected Through Our Apps

In Short We may collect information regarding your geolocation, mobile device, and push notifications when you use our apps.

If you use our Apps, we may also collect the following information:

  • Geolocation Information. We may request access to location information from your mobile device, either continuously or while you are using our mobile application, to help you find the nearest campus, view local event information, or use other location-based features. If you wish to change our access or permissions, you may do so in your device's settings.
  • Mobile Device Access. We may request access to your camera (for example, to scan a QR code at a campus, upload a profile photo, or take a picture during an interactive class). We do not request access to your contacts, SMS messages, microphone, social media accounts, or bluetooth devices. You may grant or deny these permissions and may change them at any time in your device's settings.
  • Mobile Device Data. We may automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information, and IP address.
  • Push Notifications. We may request to send you push notifications regarding your account, the mobile application, or upcoming services and events. If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.

Information Collected From Other Sources

In Short We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources.

We may obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms (such as Facebook), and from other third parties. Examples of the information we receive from other sources include: social media profile information (your name, gender, birthday, email, current city, state and country, user identification numbers for your contacts, profile picture URL and any other information that you choose to make public); marketing leads and search results and links, including paid listings (such as sponsored links).

How Do We Use Your Information?

In Short We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and your consent.

We use personal information collected via our Sites or Apps for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests ("Business Purposes"), in order to enter into or perform a contract with you ("Contractual"), with your consent ("Consent"), and for compliance with our legal obligations ("Legal Reasons"). We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

  • To send administrative information to you for Business Purposes and Legal Reasons. We may use your personal information to send you information about Legacy Church services, events, ministries, and changes to our terms, conditions, and policies.
  • Process donations, registrations, and enrollments for Contractual reasons. We use your information to process and confirm your donations, event registrations, conference sign-ups, class enrollments, group sign-ups, and other transactions made through the Sites or Apps.
  • Provide relevant content for our Business Purposes. We may use your information to provide content suited to your campus, ministry interests, or stage of life (for example, showing event information for the campus nearest you, or recommending a ministry that fits your family). We do not use your information for cross-site behavioral advertising.
  • Request feedback for our Business Purposes. We may use your information to request feedback and to contact you about your use of our Sites or Apps.
  • To protect our Sites for Legal Reasons. We may use your information as part of our efforts to keep our Sites or Apps safe and secure (for example, for fraud monitoring and prevention).
  • To enforce our terms, conditions, and policies for Business Purposes or for Legal Reasons.
  • For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our ministry communications, and evaluating and improving our Sites, Apps, services, and your experience.

Will Your Information Be Shared With Anyone?

In Short We only share information with your consent, to comply with laws, to protect your rights, or to fulfill business obligations.

We only share and disclose your information in the following situations:

  • Trusted Service Providers. We share information with third-party vendors and service providers that perform services on our behalf, such as payment processing (Pushpay), church management software, mobile app hosting, event registration, livestream and video hosting, email delivery, analytics, and background checks for ministry volunteers. These providers are bound by contract to use your information only as needed to perform their services for us.
  • Compliance with Laws. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • Vital Interests and Legal Rights. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person, illegal activities, or as evidence in litigation in which we are involved.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of organizational assets, financing, or acquisition of all or a portion of our operations to another organization.
  • With Your Consent. We may disclose your personal information for any other purpose with your consent.

We do not sell, rent, lease, or trade your personal information, including your donor name and giving history, with any third party for marketing or commercial purposes. Text messaging originator opt-in data and consent will not be shared with any third parties unless required by law.

Do We Use Google Maps?

In Short Yes, we use Google Maps for the purpose of providing better service.

This website, mobile application, or Facebook application uses Google Maps APIs.

By using our Maps API Implementation, you agree to be bound by Google's Terms of Service. You agree to allow us to obtain or cache your location. You may revoke your consent at any time. We use information about location in conjunction with data from other data providers.

How Long Do We Keep Your Information?

In Short We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than the period of time in which users have an account with us.

As a 501(c)(3) nonprofit organization, we are required to keep donation records for charitable contribution substantiation under Internal Revenue Code Section 170 and related regulations. Donation records are generally retained for a minimum of seven years, consistent with IRS guidance and our internal record retention policy. Background check records for ministry volunteers are retained in accordance with applicable state law and the service provider's retention policy.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

How Do We Keep Your Information Safe?

In Short We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. In accordance with the New Mexico Data Breach Notification Act (NMSA 1978, §§ 57-12C-1 et seq.), we maintain reasonable security procedures and practices appropriate to the nature of the personal identifying information we hold. When we share personal identifying information with third-party service providers, we require by contract that those service providers implement and maintain reasonable security procedures as well. When records containing personal identifying information are no longer reasonably needed for business purposes, we arrange for proper disposal by shredding, erasing, or otherwise modifying the information so that it is unreadable or undecipherable.

However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Sites or Apps is at your own risk. You should only access the services within a secure environment.

Donations, Giving, and Tax Statements

In Short We use Pushpay to process online giving. Your donor information is kept confidential and is used only to record your gift, issue receipts, and meet IRS requirements for charitable contributions.

As a 501(c)(3) nonprofit organization (EIN 85-0280270), Legacy Church takes donor privacy seriously.

Payment Processing

Online donations made through our Sites, Apps, and giving kiosks are processed by Pushpay, a PCI-compliant payment processor. When you give online, your full payment card or bank account information is submitted directly to Pushpay and is not stored on Legacy Church systems. We receive only the transaction details necessary to record your gift, issue a receipt, and prepare year-end tax statements. Pushpay's privacy policy is available at pushpay.com/privacy.

Tax Statements and IRS Reporting

Federal tax law requires us to maintain accurate records of charitable contributions. We use your contact information and giving history to issue receipts for individual gifts, prepare annual giving statements, and produce any other documentation required to substantiate a charitable deduction under Internal Revenue Code Section 170. You may view your giving history and download your annual statement online through MyLegacy at legacychurch.com/mylegacy.

Donor Privacy Commitment

We do not sell, rent, lease, trade, or otherwise share donor names, giving amounts, or other donor information with third parties for marketing or commercial purposes. We will only disclose donor information in the following circumstances:

  • To the donor and to authorized members of Legacy Church staff and leadership with a legitimate need to know
  • To trusted service providers (such as Pushpay) acting on our behalf, under contractual confidentiality obligations
  • For accounting, audit, or legal compliance purposes
  • Where the donor has consented to public recognition (for example, on a sponsor list or in a thank-you announcement)
  • Where required by law or court order

Pledges and Giving Commitments

If you submit a giving commitment (such as a Just One More pledge or capital campaign card), we may use that information to follow up with you about your commitment, send giving reminders, and report aggregate (not individually identifying) progress to our congregation.

Children and Family Ministries

In Short We take special care with information about children and families who participate in our preschool (LTots), elementary (LKids), youth (Legacy Students), Legacy Academy, and other family ministries.

Children Under 13

Our Sites and Apps are not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13 online without verifiable parental consent. If you believe we have collected information from a child under 13 without proper consent, please contact us using the information in Section 16 and we will promptly investigate and delete the information as appropriate.

Family Check-In

When you check your child into one of our ministries, we collect the child's name, age or grade, parent or guardian name, contact phone number, any allergy or medical notes you choose to share, and authorized pickup persons. This information is used solely to keep your child safe and to reunite them with you at the end of the service through our secure name-and-number tag matching system.

Registration and Programs

For camps, conferences, classes, and programs that include minors (such as LKids Camp, Legacy Student Conference, baby dedications, water baptism, and Legacy Academy enrollment), we may collect additional information such as date of birth, school grade, emergency contacts, medical conditions, dietary needs, and signed release forms. This information is used only to operate the program safely and is shared only with the staff and volunteers responsible for your child's care.

Volunteer Background Checks

To protect children in our care, all staff and volunteers who serve in our children's, student, and family ministries are subject to a background check before they begin serving. Background check information is collected through a third-party screening service, kept confidential, and accessed only by authorized personnel involved in the screening and approval process.

Parental Rights

If you are the parent or legal guardian of a child whose information we hold, you may request to review the information, update it, or request its deletion. To make such a request, please contact us using the information in Section 16.

Photography, Video, and Livestreaming

In Short Our services and events are recorded, livestreamed, and photographed. By attending, you acknowledge that you may appear in those recordings.

Recording of Services and Events

Worship services at all Legacy Church campuses and most ministry events are recorded for livestream, sermon archive, podcast, social media, television broadcast, and other church communications. By attending, participating, or volunteering at a Legacy Church service, conference, camp, class, or event, you acknowledge that you may be photographed, filmed, or recorded, and you grant Legacy Church the right to use your likeness in those recordings and in related promotional materials without further notice or compensation.

Children in Photographs and Recordings

We take particular care with images and recordings of minors. Parents and guardians may request that images of their children not be used in publicly distributed Legacy Church materials by contacting us using the information in Section 16. We will make reasonable efforts to honor such requests in future publications.

Livestream Chat and Social Media Comments

If you participate in livestream chat, social media comments, or other public conversations on our platforms (such as YouTube, Facebook, Instagram, or our app), please be aware that your username, profile photo, and comments are visible to other participants and may be retained by the underlying platform according to that platform's own terms.

Removal Requests

If you believe an image, video, or recording of you has been published in a manner you would like reconsidered, contact us using the information in Section 16. We will work in good faith to address your concern, although we cannot guarantee removal from third-party platforms or distributed copies already in circulation.

In Short You may review, change, or terminate your account at any time.

Do California Residents Have Specific Privacy Rights?

In Short Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Do New Mexico Residents Have Specific Protections?

In Short Yes. As a New Mexico-based organization, we follow New Mexico's data security and breach notification laws to protect the personal information of our New Mexico community.

Legacy Church is headquartered in Albuquerque, New Mexico. We comply with the New Mexico Data Breach Notification Act (NMSA 1978, §§ 57-12C-1 et seq.) and other applicable New Mexico privacy laws. As a New Mexico resident, you have the following protections:

  • Reasonable security measures. We maintain reasonable security procedures and practices appropriate to the nature of the personal identifying information we hold, designed to protect that information from unauthorized access, destruction, use, modification, or disclosure.
  • Breach notification. If we discover a security breach involving unencrypted personal identifying information that poses a significant risk of identity theft or fraud, we will notify affected New Mexico residents in the most expedient time possible, and within forty-five (45) calendar days following discovery, in accordance with state law.
  • Proper disposal of records. When records containing personal identifying information are no longer reasonably needed for business purposes, we arrange for proper disposal by shredding, erasing, or otherwise modifying the information so it cannot be read or reconstructed.
